Instagram Collaboration Terms

1. Overview

FLOWW Network ("FLOWW," "we," "us," or "our") features and collaborates with athletes, photographers, videographers, schools, sponsors, partners, and fans on Instagram. Most often, others collaborate with us — by requesting to be featured, co-posting with us, tagging us, or sending us content — and from time to time we invite collaborations ourselves. These Instagram Collaboration Terms ("Terms") apply to collaborations in both directions.

By requesting or accepting an Instagram "Collab" with FLOWW Network, co-authoring a post or Reel with us, asking to be featured, participating in a feature or takeover, tagging FLOWW Network, using a hashtag we designate for a campaign, or submitting content to us, you ("you," "Collaborator") agree to these Terms. If you do not agree, please do not collaborate with us or send us content.

2. What Counts as a Collaboration

These Terms apply to any of the following, whether you approach us or we approach you:

  • Requests to be featured or to collaborate that you send to FLOWW Network;
  • Instagram Collab posts and Reels co-authored with FLOWW Network;
  • Account takeovers, athlete spotlights, and feature content;
  • Photographer and videographer features where you submit or co-post game or event media;
  • Sponsor, brand, and partner cross-promotions; and
  • Fan and user-generated content (UGC) submitted by tagging us, using a designated hashtag, or sending content to us by direct message or other means.

3. Eligibility

To collaborate with us, you must:

  • Have an Instagram account in good standing and comply with Instagram's and Meta's own terms and policies;
  • Provide accurate information about yourself; and
  • Have the right to share any content you provide (see Section 6).

If you are under 18, a parent or legal guardian must review and agree to these Terms on your behalf, and we may ask for confirmation of that consent before featuring you or your content.

4. Student-Athletes, Minors & NIL

Much of our content involves high school student-athletes. If a collaboration features a minor or a student-athlete:

  • A parent or legal guardian must consent to the collaboration and the use of the student-athlete's name, image, likeness, and content.
  • Collaborators are responsible for ensuring the collaboration complies with all applicable Idaho High School Activities Association (IHSAA) rules, school policies, and Idaho name, image, and likeness (NIL) laws and guidelines.
  • Editorial coverage by FLOWW Network — such as game coverage, highlights, scores, and athlete features — is journalistic and promotional in nature and is not a paid endorsement or NIL deal, unless a separate written agreement expressly says otherwise.
  • We will remove or decline content involving a minor at the request of that minor's parent or legal guardian, or the relevant school, where reasonably possible.

5. Compensation

Compensation for Instagram collaborations varies. Some collaborations are unpaid and exposure-based; others are paid. Any payment, product, service, or other compensation will be defined in a separate written agreement for that specific collaboration. Unless such an agreement exists, a collaboration is unpaid, and tagging, featuring, or reposting does not create an obligation to pay.

6. Content Ownership & License

You keep ownership of the original content you create. By collaborating with us or submitting content, you grant FLOWW Network a non-exclusive, worldwide, royalty-free, transferable, sub-licensable, and perpetual license to use, host, store, reproduce, edit, adapt, crop, re-caption, publish, display, and distribute that content — and your name, handle, likeness, and the content's metadata — across all FLOWW Network platforms and channels, including Instagram, our website, other social media, newsletters, and marketing or promotional materials.

You confirm that:

  • You own or have all rights necessary to grant this license;
  • The content does not infringe anyone's intellectual property, privacy, or publicity rights; and
  • You have obtained any consents needed from people who appear in the content (including parent/guardian consent for minors).

This license continues for content already created or posted even if the collaboration ends.

7. Content Standards

All collaboration content must:

  • Be accurate and not misleading;
  • Be sportsmanlike and respectful — no hate speech, harassment, bullying, threats, or discriminatory content;
  • Contain no sexually explicit, violent, illegal, or otherwise objectionable material;
  • Use no music, footage, photography, logos, or trademarks you do not have the rights to use; and
  • Comply with Instagram's and Meta's policies and all applicable laws.

8. Credit & Tagging

We will make reasonable efforts to credit Collaborators by tagging their Instagram handle on co-authored or featured content. Collaborators are encouraged to tag and credit @FLOWWNetwork when sharing collaboration content. Credit may not always be possible for every format or repost, and a failure to credit is not a breach of these Terms.

9. Sponsored Content & Disclosure

If a collaboration is paid or sponsored, both parties must clearly disclose the relationship as required by the Federal Trade Commission (FTC) and Instagram — for example, using the Paid Partnership label and tags such as #ad or #sponsored. Collaborators are responsible for making proper disclosures on content they post from their own accounts.

10. Removal & Termination

We may decline, edit, or remove any collaboration content at any time, for any reason, without notice. Either party may end a collaboration at any time. Ending a collaboration does not affect the license in Section 6 for content already created or posted, and does not require us to remove content already published.

11. Disclaimers & Limitation of Liability

Collaborations and all related content are provided "as is." To the fullest extent permitted by law, FLOWW Network is not liable for any indirect, incidental, or consequential damages arising from a collaboration. A collaboration does not create any employment, agency, partnership, or joint venture relationship between you and FLOWW Network.

12. Indemnification

You agree to indemnify and hold harmless FLOWW Network and its team from any claims, damages, or expenses (including reasonable legal fees) arising from content you provide, your breach of these Terms, or your violation of any law or third-party right.

13. Not Affiliated with Instagram or Meta

FLOWW Network is not affiliated with, endorsed by, sponsored by, or administered by Instagram or Meta Platforms, Inc. Instagram is a trademark of Meta Platforms, Inc.

14. Changes to These Terms

We may update these Terms from time to time. The current version will always be posted on our website with its effective date, and continued collaboration after an update means you accept the revised Terms.

15. Governing Law

These Terms are governed by the laws of the State of Idaho, without regard to its conflict-of-laws rules.
